Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and A+ Logistics Corporation ("A+ Logistics," "we," "us," or "our") governing your use of our warehouse logistics technology services, website, and package tracking systems.

By accessing our website, using our tracking services, or shipping packages through A+ Logistics, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services Description

A+ Logistics provides warehouse logistics technology services including, but not limited to:

  • Package tracking and supply chain visibility systems
  • Warehouse storage and distribution services
  • Freight transportation and shipping solutions
  • Order fulfillment and e-commerce logistics
  • Real-time notification services for shipment updates
  • Integration with third-party logistics platforms

Our services are subject to availability and may be modified, suspended, or discontinued at any time without prior notice.

3. User Accounts

To access certain features of our warehouse technology platform, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account
  • Not share your account credentials with third parties

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Shipping Terms and Conditions

4.1 Package Acceptance

A+ Logistics reserves the right to refuse service for any package that:

  • Contains prohibited or restricted items (see Section 4.3)
  • Exceeds dimensional or weight limitations
  • Lacks proper packaging or labeling
  • Violates applicable laws or regulations
  • Poses a safety risk to our warehouse operations

4.2 Liability Limitations

A+ Logistics' liability for loss or damage to shipments is limited to:

  • $100 per package unless additional insurance is purchased
  • Documented actual value of the package contents
  • Exclusions apply for declared value discrepancies, force majeure events, and shipper negligence

A+ Logistics is not liable for delays caused by weather, natural disasters, carrier disruptions, customs inspections, or other events beyond our reasonable control.

4.3 Prohibited Items

The following items are strictly prohibited from shipment through A+ Logistics:

  • Hazardous materials, explosives, and flammable substances
  • Illegal drugs, controlled substances, and drug paraphernalia
  • Weapons, ammunition, and firearm components
  • Perishable goods without proper packaging and expedited service
  • Live animals (except as permitted by specific programs)
  • Currency, negotiable instruments exceeding $500
  • Stolen goods or items violating intellectual property rights

Shippers are solely responsible for ensuring package contents comply with all applicable laws and regulations.

5. Pricing and Payment

Shipping rates are determined based on package dimensions, weight, destination, service level, and current pricing schedules. You agree to:

  • Pay all applicable fees and charges for services rendered
  • Provide valid payment information
  • Accept responsibility for any chargebacks or payment disputes
  • Pay applicable taxes, duties, and customs fees

A+ Logistics reserves the right to modify pricing at any time. Price changes will not affect shipments already in transit.

6. Tracking and Technology Services

Our warehouse logistics tracking technology provides estimated package location and delivery information based on:

  • Barcode scans at warehouse checkpoints
  • GPS and network-based location data
  • Carrier integration and third-party data sources

Important: Tracking information is provided as a courtesy and for informational purposes only. While we strive for accuracy, tracking data may be delayed or contain errors. A+ Logistics does not guarantee the precision or timeliness of tracking updates.

7. Delivery Terms

Delivery timeframes are estimates and not guaranteed unless specifically stated in writing. "Business days" exclude weekends and holidays. Delivery may require:

  • Signature confirmation (for certain service levels)
  • Recipient availability at delivery address
  • Access to delivery location during business hours

If delivery cannot be completed, packages may be returned to sender at the shipper's expense or held at a local facility for pickup.

8. Claims and Disputes

Claims for lost, damaged, or delayed shipments must be filed within:

  • 9 months from the ship date for domestic shipments
  • 120 days from the ship date for international shipments
  • 30 days from delivery date for damage claims

Claims must include supporting documentation such as proof of value, photographs of damage, and original packaging materials.

9. Intellectual Property

All content on the A+ Logistics website, including logos, text, graphics, software, and tracking technology, is the property of A+ Logistics Corporation and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or create derivative works from our content
  • Use our trademarks without written permission
  • Reverse engineer our tracking systems or software
  • Access our systems through automated means (bots, scrapers) without authorization

10. Privacy and Data Use

Your use of A+ Logistics services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal information and shipment data as described in our Privacy Policy.

By using our services, you consent to the collection, processing, and sharing of data necessary for warehouse operations, tracking services, and delivery fulfillment.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A+ LOGISTICS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, or punitive damages
  • Lost profits, revenue, or business opportunities
  • Service interruptions or technology failures
  • Third-party actions or carrier performance
  • Acts of God, terrorism, or government actions

Our total liability for any claim shall not exceed the greater of (a) the shipping charges paid for the affected shipment, or (b) $100.

12. Indemnification

You agree to indemnify and hold harmless A+ Logistics, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your violation of these Terms
  • Your shipment of prohibited or restricted items
  • Inaccurate or false information provided by you
  • Your violation of applicable laws or third-party rights

13. Force Majeure

A+ Logistics shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather, or acts of God
  • Labor disputes, strikes, or workforce shortages
  • Government actions, war, terrorism, or civil unrest
  • Pandemics, epidemics, or public health emergencies
  • Utility failures, infrastructure damage, or technology outages

14. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  • Informal Resolution: First, contact our customer service at support@apluslogistics.com
  • Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules
  • Class Action Waiver: You agree to bring claims individually and waive participation in class actions

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

15. Modifications to Terms

A+ Logistics reserves the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting updated Terms on our website with a new "Last Updated" date
  • Sending email notification to registered users (when feasible)

Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and A+ Logistics regarding the use of our services and supersede all prior agreements and understandings.
